As a New Jersey Bankruptcy lawyer, my ultimate goal is to make this process as easy, stress-free, and as quick as possible for you.  There are only 5 things you will need to do in order to have a complete bankruptcy, wiping away all of your unsecured debts…

#1: Phone Call

The process begins when you call my office.  I will give you a free over-the-phone consultation that lasts about 10 minutes where I try and assess whether you qualify for bankruptcy and whether bankruptcy makes sense for you given your current financial predicament.

#2: Complete Bankruptcy Questions

If I determine that you qualify for bankruptcy and you want to file, then I will send you a questionnaire for you to fill out, you can email it back to me, submit it to my website, or mail it to me at my office.

#3: 45-Minute Credit Counseling Course

A recent amendment to the bankruptcy code requires filers to complete a credit-counseling course before filing for bankruptcy.  You can take this course over the phone or by the Internet.  The course costs around $50.

#4: Attend Meeting of Creditors

This should be a 5-minute meeting with the trustee in charge of your case who asks you a few questions trying to decipher whether you’ve answered everything in the petition honestly and accurately, and whether there are any other outstanding assets not listed in the bankruptcy petition that he could sell to pay off your creditors.  For most of my clients, this is a very short meeting.  I will of course, prep you the night before so you are fully prepared.

#5: 45-Minute Financial Management Course

This is also a new requirement.  You can take this course by phone or over the Internet. It costs around $50.
